concept

Principled Non-Killing Under Risk / 风险中的不杀原则

Definition

Principled non-killing under risk is a refusal to kill that remains binding when lethal force would be advantageous, making restraint morally substantive while leaving separate duties of protection, containment, judgment, and truth unresolved.

Current Synthesis

Personal restraint becomes morally substantive when it survives genuine danger, as 楚留香’s rule does against 石观音 in 《大沙漠》. The same test exposes a responsibility problem: the hero does not bear the risk alone when 胡铁花, 姬冰雁, hostages, or future victims remain exposed. Non-killing therefore requires credible containment, incapacitation, rescue, lawful judgment, escape, or another protective route. Reliance on a sudden intervention can otherwise turn ethical consistency into narrative cost-shifting.

Death changes rather than dissolves those duties. When 无花 kills himself in 《血海飘香》, no further lethal choice remains, but judgment and truth do. Chu’s grief and loyalty explain his refusal to expose the friend or permit desecration without deciding whether the Beggars’ Gang, bereaved families, and other victims should be denied the perpetrator’s identity. Non-killing, mercy toward the dead, and public accountability must therefore be evaluated separately.

Key Claims

  • A non-killing rule becomes a principle only when it constrains action under genuine pressure.
  • Personal restraint and protection of others are distinct obligations that can conflict.
  • Refusal to kill does not by itself resolve containment, rescue, or future-harm duties.
  • Death can end the immediate punishment problem without ending victims’ interest in explanation.
  • Loyalty and grief can make concealment understandable without making it impartially just.
  • Alternative success conditions can preserve restraint without pretending danger has disappeared.
  • Plot convenience becomes visible when an outside actor repeatedly bears the lethal or incapacitating work the hero refuses.

Counterevidence & Qualifications

These fictional cases do not establish a general doctrine for policing, war, self-defense, criminal procedure, or emergency ethics. The sources do not enumerate all available containment or disclosure options. Non-killing should not be equated with passivity, protective responsibility does not automatically require killing, and victims’ interest in truth does not settle every question about privacy, evidence, or public disclosure.

What Changed

  • Extended the concept from protection and containment during danger to judgment and truth after the offender’s death.
  • Added a boundary between understandable loyalty and impartial responsibility to victims.
